For most parents, there is nothing more important than ensuring the well-being of their children. According to the Texas Family Code, it is the public policy of the state to assure that children will have frequent and continuing contact with parents who have shown the ability to act in the best interest of the child; to provide a safe, stable, and nonviolent environment for the child; and to encourage parents to share in the rights and duties of raising their child after the parents have separated or dissolved their marriage.
Whether you are an unmarried, separated parent or you are in the divorce process, hiring an experienced family law attorney can assist you in securing your rights to conservator ship, possession of and access to your children.
Alicia Lackey of Lackey Law Firm P.C. understands, and as an experienced family lawyer, you can be certain that she work diligently to reach a favorable result in your child custody case. Every child custody case is different. Whether the matter is a simple agreed divorce, or a more complicated case with domestic violence or substance abuse issues, a trusted attorney in the Austin and Fredericksburg, Texas area can be invaluable.
What is Child Custody in Texas?
- Conservatorship – The Texas Family Code uses the term “conservator” to describe a parties relationship to a child. In most cases, parties can be appointed as “joint managing conservators” of the children with similar rights and duties. In other situations, it is in the child’s best interest to appoint one party the “sole managing conservator” and the other as the “possessory conservator” with different rights and duties.
- Possession Order – As part of many cases related to the parent-child relationship, the court order will contain a possession schedule, that sets out the days and times the children spend with each party. The Texas Family Code sets out the Standard Possession Order for most Texas families, but Custom Possession Orders can also be crated to meet the needs of the parties and children.
- Electronic Communication – In today’s modern world, we have the ability to be more connected than ever. Sometimes the court orders need to set out the specific communications each parent is granted with the children while the children are in the physical possession of the other parent.
