No Refusal Weekends
The Austin Police Department will enforce a “No-Refusal” initiative starting at 9 p.m. Wednesday, July 3, 2013, and ending on Sunday, July 7, 2013 at 5 a.m.
What does this mean for you…
Law enforcement has the authority to enforce “no-refusal” at any time, they just have to get a warrant to obtain a blood sample. They do need probable cause to get this warrant signed. You have the option to invoke your right to remain silent.
Obtaining this warrant also sometimes means waking up a magistrate to have a warrant signed. On no-refusal weekends, they have magistrates on-hand and ready to sign warrants. This means that the officer doesn’t have to decided if they want to go through the extra effort of finding the magistrate…they are going to get your blood sample.
